Employment Bond's objective is to provide employers with a low cost opportunity and an efficient way to find quality applicants for their organization. On one hand, they support job seekers to find a better job and on the other they refrain their existing employees from switching jobs easily by acting as an obstacle to their free mobility. Nowadays with increasing job opportunities, employees are very eager to switch jobs which is a problem for the employer as all the expenses he has incurred on the employee goes waste. To refrain this from happening and give the employers the power, employment bond has come into play.
But many employers are taking undue advantage of this option by exercising stricter norms on employees. They demand more compensation from employee (in case he decides to leave the organization within the stipulated training period) than the cost they have actually incurred on the employee for his training. Due to this now employees are on the losing end. They are reluctant to switch jobs even for genuine concerns and better opportunities. Hence, there should be a check on the extent to which this employment bond can be enforced on the employees.
For this first check should be whether the bond in question is a valid contract or not; only if it is one, the company can move to court. Then the amount of compensation the company claims should be justified by the costs incurred on the particular employees training and losses faced by company due to him. Next any act by company to manhandle the employee, like retaining original documents, creating impediments for the employee to join another job, etc. shall not be allowed and action against company must be taken in such situations. Also any condition which will violate any of the fundamental rights of employees will not be allowed under eyes of law and hence will tarnish the bond.
The employees also have to abide by norms mentioned in the bond, on failure of which they will have to face the consequences. The bond will be helpful for both employer and employee if both work within the specified norms.
